1. Age requirement
Velvetly is intended exclusively for users who are 18 years of age or older. By creating an account you confirm that you meet this requirement. We reserve the right to terminate accounts of users who do not meet this requirement.
2. What Velvetly is
Velvetly is a writing assistance tool for adult content creators. It generates draft messages in your writing style. You are responsible for reviewing all AI-generated content. By default you tap send yourself for every message. You may opt in to the auto-reply feature, which sends pre-approved drafts automatically within the fan tiers you enable. You remain fully responsible for any message sent from your account, whether you sent it or auto-reply did.
3. Acceptable use
You agree not to use Velvetly to:
- Impersonate another person or creator.
- Generate spam or unsolicited bulk messages.
- Violate the terms of service of OnlyFans, Fansly, or any other platform.
- Generate content involving minors in any sexual context (zero tolerance — immediate account termination and reporting to authorities).
- Harass, threaten, or harm any individual.
4. AI-generated content
Drafts generated by Velvetly are suggestions. When the Velvetly Chrome extension is installed, it integrates with your OnlyFans inbox so you can tap to generate drafts in place. By default you review and send each draft yourself. Auto-reply is an opt-in feature that sends approved-style drafts automatically within the fan tiers you enable. You retain full responsibility for any message sent from your account, whether by you or by auto-reply.
5. Subscription and billing
Paid plans are billed monthly in advance via Stripe. The Free plan gives you the full product at a smaller credit budget, so you can evaluate Velvetly before subscribing — there is no time-limited trial. Pricing may change with 30 days notice to existing subscribers; your existing rate stays locked for the remainder of any pre-paid period.
Invoices, payment methods, plan changes and cancellation all live in your Stripe billing portal, accessible from the dashboard Settings page. VAT is calculated automatically based on your billing country (handled by Stripe Tax).
6. Refunds and the 14-day right of withdrawal
Under EU consumer law (Article 6:230o of the Dutch Civil Code) you have 14 days to withdraw from a paid subscription after first payment. To withdraw, contact us at support@velvetly.io within the 14-day window.
Refund amount within the 14-day window:
- Less than 50% of monthly credits used: full refund.
- 50% or more of monthly credits used: proportional refund (Article 6:230s paragraph 2 of the Dutch Civil Code — partial compensation for services already delivered).
Outside the 14-day window we do not provide partial-month refunds — your access continues until the end of the current billing period when you cancel. We do offer goodwill compensation in credits at our discretion (for example after a service outage, or where a service-quality issue is documented). Billing errors (duplicate charges, wrong plan billed) are always corrected with a full refund of the disputed amount.
B2B customers (those who provided a valid VAT number at checkout) are not entitled to the 14-day withdrawal right under EU law, but may still request a refund on the grounds above.
7. Plan changes
Upgrades (e.g. Starter → Pro) take effect immediately. Stripe prorates the difference for the remainder of your billing period and your credit limit increases at the same moment. Credits already used in the current month remain counted; the new (higher) limit applies to your remaining usage.
Downgrades (e.g. Pro → Starter, or any plan → Free) take effect at the end of your current billing period. You retain full access to the higher plan and its credit limit until that date. We do not refund the unused portion of a downgrade-cycle. Once the new period starts, the lower limit applies and your monthly counter resets to zero on the regular calendar-month boundary.
If a payment fails, Stripe automatically retries up to three times over approximately three weeks. During this period your subscription stays active with full access. If all retries fail, the subscription is cancelled and your account moves to the Free plan.
8. Anti-abuse and account suspension
To protect the service for all creators we monitor for abusive billing patterns, including but not limited to:
- Repeated upgrade-burn-downgrade cycles intended to consume credits at a higher tier without paying for the corresponding period.
- Multiple accounts created with the same payment method to claim repeated 14-day refund windows.
- Chargebacks initiated after credits were consumed, where the underlying service was demonstrably delivered (we will contest such disputes with our per-action audit log as evidence).
Where abuse is established, we may: limit your account’s credit caps below the published plan limits; refuse future checkouts using the same payment method; or terminate the account. Where you believe a flag is in error, contact us at support@velvetly.io and we will review.
9. Account termination
We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behaviour, or cause harm to other users or third parties. You may delete your own account at any time from Settings; doing so cancels any active subscription effective at the end of the current billing period (or immediately if requested in writing within the 14-day withdrawal window) and removes your personal data, except records we are required by law (Algemene Wet inzake Rijksbelastingen, art. 52) to retain for 7 years for tax purposes.
10. Limitation of liability
Velvetly is provided “as is”. We make no guarantees about uptime, accuracy of AI-generated content, or revenue outcomes. To the maximum extent permitted by law, our liability is limited to the amount you paid us in the 12 months prior to any claim.
11. Governing law
These terms are governed by the laws of the Netherlands. Disputes will be resolved in Dutch courts. Velvetly is operated by Martin de Heer Holding B.V., KvK 24486893, VAT NL822019905B01.
